1. Overview

These Terms & Conditions govern your use of the Deluge Beautee LLC website (delugeb.com), including our AI Nail Advisor tool, booking system, and all related services. By using this website or booking our services, you agree to these terms.

2. SMS Messaging Terms

Deluge Beautee LLC provides appointment and order notifications via SMS text messaging. By opting in, you agree to the following:

Message and data rates may apply
Message frequency varies based on your appointment and order activity
Reply STOP at any time to unsubscribe; you will receive one confirmation message
Reply HELP for assistance, or contact us at 314-594-4494

3. AI Nail Advisor Tool

Our website features an AI-powered Nail Advisor tool that generates personalized nail style recommendations based on your inputs and uploaded photos.

By using the Nail Advisor tool, you acknowledge and agree that:

The recommendations generated are for inspiration and reference purposes only and do not constitute a professional guarantee of any specific outcome
Actual results may vary based on your natural nail condition, skin tone, and the specific products used during your appointment
You are voluntarily uploading any photos submitted through the tool
Uploaded photos may be retained by us and used as design reference for your nail service and as general inspiration reference for our work
Uploaded photos will not be used in public marketing or advertising without your separate explicit consent
We reserve the right to modify, discontinue, or update the AI Nail Advisor tool at any time

4. Appointments, Deposits & Cancellation Policy

Deposit

All appointments require a $15 non-refundable deposit to secure your booking
Deposits are applied toward your total service cost

No-Show Policy

If you have not arrived within 15 minutes of your scheduled appointment time, your appointment will be automatically cancelled and your deposit will be forfeited
You will receive an SMS notification confirming the cancellation

Rescheduling

To reschedule, text RESCHEDULE to our booking number at least 2 hours before your appointment
If you reschedule with 2+ hours notice, your deposit is saved and will be automatically applied to your next booking
If you reschedule with less than 2 hours notice, your deposit is forfeited
If you reschedule with less than 2 hours notice, your $15 deposit is forfeited, however it will be held as a credit toward your next booking if you rebook within 14 days. After 14 days, the deposit is permanently forfeited.
You will receive a 24-hour reminder SMS before your appointment with rescheduling instructions

Same-Day Cancellations

Cancellations made less than 2 hours before your appointment will result in forfeiture of your deposit. Your deposit will be held as a booking credit for 14 days rebook within that window to apply it toward your next service. After 14 days, the credit expires.

5. Satisfaction Guarantee

We stand behind our work. If you experience any issues with your service, we will make it right at no charge to you.

What's covered:

Lifting, peeling, or premature breakage not caused by client mishandling
Uneven application, shape inconsistencies, or finish defects
Lash extensions that fall out abnormally (beyond normal natural shedding)
Any service outcome that does not match what was agreed upon at the time of booking

How it works:

Include a photo of the issue so we can assess it before your visit
We will schedule a complimentary fix appointment or, if the issue cannot be corrected, offer a complimentary new service of equal or lesser value

What's not covered:

Damage caused by improper aftercare (e.g., excessive water exposure, picking, or peeling)
Normal wear and natural nail growth separation after 7 days
Dissatisfaction due to a change of mind on style, color, or shape after the service is complete
Services performed on nails that were flagged as potentially problematic at the time of booking

Press-on sets: Handmade press-on sets are non-refundable once shipped or handed off. If there is a sizing or quality defect, contact us within 7 days of receipt and we will work with you on a replacement or credit.

6. Press-On Nail Orders

Custom press-on nail sets are made to order and are non-refundable once production has begun
If your order arrives damaged or incorrect, contact us within 48 hours of delivery for resolution
We are not responsible for damage resulting from improper application or removal

7. Intellectual Property & Copyright

All content on this website including but not limited to the AI Nail Advisor tool concept and design, website design, text, graphics, nail photos, and branding is the original creative work of Deluge Beautee LLC and is protected under applicable U.S. copyright law.

You may not reproduce, copy, distribute, or use any content from this website for commercial purposes without prior written permission from Deluge Beautee LLC. Unauthorized reproduction of the AI Nail Advisor tool concept, design, or functionality is strictly prohibited.

Some nail designs created by Deluge Beautee LLC may be inspired by popular culture, characters, or artistic works. All such designs are original handmade artistic interpretations created by our nail technician and are not affiliated with, endorsed by, or sponsored by any third-party brand or intellectual property holder. These designs are offered as custom artistic services only and are not mass-produced or sold as licensed merchandise.

8. DMCA & Copyright Takedown Policy

Some inspiration images displayed through our AI Nail Advisor tool are sourced from publicly available references for the purpose of nail style inspiration and design reference.

If you are the copyright owner of an image displayed through our tool and believe your work has been used without authorization, you may submit a takedown request by contacting us with the following information:

Identification of the copyrighted work you believe has been infringed
A link or description of where the image appears on our site
Your contact information (name, email or phone)

We will review and respond to all valid takedown requests promptly and remove any disputed content within a reasonable timeframe.

9. Limitation of Liability

Deluge Beautee LLC is not liable for any indirect, incidental, or consequential damages arising from your use of our website, AI Nail Advisor tool, or services. Our total liability in any matter is limited to the amount paid for the specific service in question.

10. Changes to These Terms

We may update these Terms & Conditions at any time. Continued use of our website or services after changes are posted constitutes your acceptance of the updated terms.

11. Governing Law

These terms are governed by the laws of the State of Missouri, United States.

The following tools, systems, and concepts developed by Deluge Beautee LLC are proprietary and constitute trade secrets protected under the Missouri Uniform Trade Secrets Act and applicable federal law:

Color Soul™ multi-layer color matching system combining skin tone analysis, zodiac sign, feng shui element, and year energy to generate personalized color profiles for nails, fashion, and lifestyle
Soul Reading™ multi-layer personal reading system combining 64 I Ching birth hexagrams, Tử Vi astrology (Chính Tinh/Cung Mệnh), Ngũ Hành five elements, Nạp Âm birth-year element, and Western zodiac to generate personalized soul profiles and life season archetypes
Soul Match™ compatibility engine combining Tử Vi Birth House pairing, Ngũ Hành elemental relationships, and archetype communication styles to generate dynamic relationship insights across five categories (Love, Friendship, Business, Communication, Conflict Style)
AI Nail Advisor™ concept, design, logic, and user flow for AI-powered personalized nail style recommendations
Nail Fit™ camera-based nail measurement tool using coin calibration to detect finger dimensions and match clients to artist-specific press-on size charts
Booking automation system: including SMS confirmation flows, OTP verification, and admin notification architecture
Client color profile data and aggregated palette data generated through the Color Soul™ system
Artist subscription platform and size chart matching infrastructure powering the Nail Fit™ tool

You may not reverse engineer, copy, replicate, or commercialize any of the above systems or concepts without prior written permission from Deluge Beautee LLC.
